昨日３月１４日（水）、「関西総合調査業協協会」の教育研修会が開催された。

研修内容は、今年６月１日から施行される「探偵業の業務の適正化に関する法律」について、

素人は素人なりに万全を期し、キッチリと条文を頭に叩き込んで研修に望もうと考えていた。

ところが先週から今週にかけ何時に無く雑用が重なり、殆ど勉強する時間が取れなかった。しかも、前日は月１回、
私の会社で開いている囲碁会の日。碁会は業務が終わる６時頃からで、メンバーは以前、南森町に所在した碁会所「マルサン」の会員で、
同時期に日本棋院初段の免状を貰った（取ったではない）メンバーである。それに、往時の碁会所「マルサン」の席主が指導してくれる。
棋力互角のヘボ碁士の集まりであり、この上なく楽しい碁会となる。夕方になると仕事もそこそこにその準備にかかる。
自らいそいそと近くのスーパーに出掛け、食料を仕入れ、準備万端手ぐすねを引いて碁仇の来るのを待つわけである。
こうなると仕事の事など眼中にない。黒・白・クロ・シロ、頭の中は碁石で一杯になり、時間の経つのも忘れる。結局お開きとなったのが１１時、
少しでも早く帰って明日の準備をと思ったが、碁で負けが込んだ悪友が「エーイ・・一杯いこう」と声をかけて来た。勝ち逃げは卑怯、
男なら付き合わざるをえない。渋々かいそいそかは別にして足は自然と新地に向いていた。結局我が家にたどり着いたのは午前さま。

当日は案の定二日酔い。ボーとした頭で出社し、研修に向けての勉強を始めたが胸はムカムカ、頭はガンガン。
それでも午後には何とか研修会の演壇に立ち、２時間判ったような分からない話をして無事務めを果たした。

探偵業法は、議員立法であり、可也荒削りなところがある。しかも、消費者保護（依頼者及び被調査人）を大前提としており、
業者の育成などは全く考慮されていない。所管は公安委員会で直接は警察である。個人情報保護に人権の視点が強く反映され、
しかも依頼者保護の為契約には相当細かい事まで入れなければならない。

依頼者の要求に誠実に応える為には、時には灰色ぽい事にも手を染めなければならない仕事であるが、今度の業法では
「人の生活の平穏を害する等個人の権利利益を侵害することがないようにしなければならい。」
（探偵業務の実施の原則）とし、これは単なる訓示規定ではなく、罰則の対象となる
「この法律に違反した場合に」該当するなどと、立法段階の内閣委員会で、提案者が答弁している。また、
人権の視点でも、依頼者から
「差別的取り扱いその他の違法な行為のために用いない旨を示す書面の交付受けなければならない」
と規定している事項について、相当な研究と議論を重ねなければならない問題を、内閣委員会の答弁でサラッと答弁して片付けている。
素人目にも、本当にこんな事で法律がつくられていいのか・・？という感じであるが、出来たものは仕方が無い。

今後の探偵業務は、相当な努力と忍耐で、今までに倍しての時間と労力をかけないと、
真に依頼者の期待に沿える調査は難しくなるものと思わて仕方が無い。
