怒り心頭

「今日一日 怒らず、恐れず、悲しまず、 正直、親切、愉快に、  力と勇気と信念とをもって、 自己の人生に対する責務を果たし、 常に平和と愛とを失わざる、 立派な人間として生きることを、 厳かに誓います。」

と言うのが天風会員の「誓いに言葉」であり、毎朝、目覚めと同時に、これを黙誦している。

  1. しかし、これは怒らずにおれるか・・・。

ところが、天風先生は、「それが君たちのダメなところなんだよ・・・」という。怒りの感情が発生するのは、それは仕方ない。でも、その感情を瞬時に切り替えなさい。その方法は・・・・と教えて下さっている。が、やはり、これは、しかし、凡人には怒らずにおれないのだ・・・・・。

平成25年8月29日、警視庁生活安全部生活安全総務課が主催する「探偵業者研修会」が東京で開催されたとの事(小生は参加していない)。その席で配布された資料の中に「採用と人権」(東京都産業労働局 東京労働局・ハローワーク)なる冊子の抜粋されたものがあり、その中で、

(5)身元調査 (守るべきことがら)、とあり、

? 採用に関する身元調査は絶対にしないでください。

? 本籍地、出身地、思想及び信条等の個人情報の収集はしてはいけませ ん。

とあった。同様の文章は30年も前から変わることなく、「採用と人権」を筆頭にあらゆる書籍で目にしてきたものである。しかし、従来は、身元調査云々の前に「差別につながる」の一語があり、解釈次第で、全ての身元調査を禁止しているのではなく、あくまで、差別につながる身元調査を禁止していると、して一様の理解を示してきた。

しかし、今回は「採用に関する身元調査は絶対にしてはいけない」とある。解釈もくそもない。まさに、ジェジェジェ・・・。

何を根拠にこんな事を言っているのであろう。行政が発行し行政官が指導しているのだから、法的根拠があっての事でなければならないが、小生の知識の範囲では、「採用に関する身元調査は絶対にしてはいけない」とまで言える法的根拠を知らない。

一運動団体や学者が、自説として訴えるのはなんら問題はないし、そう考え思う人は、そうすれば良い。ただ行政官が言ったとなると話は別。由々しき問題と言わざるを得ない。

百歩譲って、議論の余地があるとするとすれば、「身元調査」と言う言葉の定義であろう。まさか定義もなしに、この言語を使っているとは思えないが・・・。

古いことではあるが、会議の席で小生は官僚に「身元調査」の定義をたずねたことがある。しかし、官僚はその席では答えられず、その後も答えてもらう事はかなわなかった。

就職応募者(中途)の30%強に経歴詐称がみられ、職務経歴書の中身たるや針小棒大も甚だしく、中には学歴や現住所まで詐称している人がいると云うのに、理由のいかんを問わず、確認をしてはいけない、と云うのが、東京都産業労働局が発行する「採用と人権」の中身である。

「思想及び信条等の個人情報の収集はしてはいけませ ん。」と断言しているが、これについても法的根拠を持っての事であろうか?。

 

三菱樹脂事件判例 裁判要旨(昭和48年12月に最高裁大法廷で出された判決で、しかも、裁判官15名中、全員が賛同した判例である)

  1. 憲法14条や19条は、もっぱら国または公共団体と個人の関係を規律するもので、私人相互の関係を直接規律することを予定したものではない。
  2. 企業者は、自己の営業のために労働者を雇傭するにあたり、いかなる者を雇い入れるか、いかなる条件でこれを雇うかについて、法律その他による特別の制限がない限り、原則として自由にこれを決定することができるのであって、企業者が特定の思想、信条を有する者をそのゆえをもって雇い入れることを拒んでも、それを当然に違法とすることはできない。
  3. 企業者が、労働者の採否決定にあたり、労働者の思想、信条を調査し、そのためその者からこれに関連する事項についての申告を求めることも、これを法律上禁止された違法行為といえない。
  4. 労働基準法3条は雇入れそのものを制約する規定ではない。
  5. 新卒採用にあたり、採否決定の当初においては、その者の資質、性格、能力その他上告人のいわゆる管理職要員としての適格性の有無に関連する事項について必要な調査を行ない、適切な判定資料を十分に蒐集することができないため、後日における調査や観察に基づく最終的決定を留保する趣旨でされるものと留保解約権の行使にあたっては、上述した解約権留保の趣旨、目的に照らして、客観的に合理的な理由が存し社会通念上相当として是認されうる場合にのみ許される。

最高裁判例は一つの法律であり、以後、その判例を覆す判例が出ない限り、その判例は法律として護らなければならないものと小生は心得ている。で、この三菱樹脂判例以後、この判例を覆す判例が出た事を知らないが、何故に最高裁判例を無視して、行政がこの様な指導をするのであろう。

尚、憲法の基本的人権保障規定は、原則的には「国家」対「私人」における関係について適用されることが予定されているものであり、私人相互の関係を直接規律するものを予定するものではない、とされているが、最近特に感じることは、この国家が国民に対し守らなけらばならない事を、私人間にまで持ち込み、権利主張をする人が非常に多くなって来ているように思う。少なくとも国民は義務を果たし権利を保障されるのであり、義務は放棄し権利だけを主張する最近の社会風潮は、非常に残念に思う。

青柳武彦教授は「個人情報「過」保護が日本を破壊する」と題する本まで出版しているが、まさしく私もそう思う。

But can you do this without getting angry…
However, Tenpou-sensei said, “That’s what’s wrong with you guys… It can’t be helped that feelings of anger will arise. But switch those feelings instantly. The way to do it is…” he tells us. But this, after all, is something no ordinary person can do without being angry…..

On August 29th, 2013, a “detective agency workshop” was held in Tokyo, hosted by the Life Safety and General Affairs Division, Life Safety Department, Metropolitan Police Department (I did not attend). One of the materials distributed at the meeting was an excerpt from a booklet called “Employment and Human Rights” (Tokyo Metropolitan Bureau of Industry and Labor, Tokyo Labor Bureau, Hello Work), in which

(5) Background check.

? Never run a background check on recruitment.

The Company shall not collect any personal information such as birthplace, birthplace, ideology or beliefs. You may not collect any personal information such as your legal domicile, place of birth, ideology or beliefs.

and was. Similar passages have remained unchanged for 30 years and have been seen in every book, starting with “Recruitment and Human Rights”. In the past, however, there was a single word “leading to discrimination” before the word “background check” and, depending on the interpretation, it has been uniformly understood that it does not prohibit all background checks, but merely prohibits background checks that lead to discrimination.

This time, however, it says, “There should never be a background check on recruitment. There is no interpretation and no bullshit. Just like that, Je Je Je…

On what basis does he say this? However, to the best of my knowledge, I don’t know of any legal basis for saying that “background checks on recruitment are absolutely prohibited.

There is nothing wrong with a movement or a scholar appealing to it as a theory, and those who think so should do so. It’s a different story when it’s said by a government official. I have to say, it is a grave problem.

If there is one thing that can be argued, it would be the definition of the word “background check”. I don’t think you’re using this language without a definition…

I once asked a bureaucrat at a meeting for the definition of “background check”, though it was a long time ago. However, the bureaucrat couldn’t answer at that table, and he couldn’t get them to answer afterwards.

More than 30% of job applicants (mid-career) are found to be career falsifiers, and the contents of job resumes are extremely large, with some of them misrepresenting their academic background and even their current address, but regardless of the reason, they should not be checked.

You may not collect any personal information, such as thoughts or beliefs. Is there a legal basis for this as well?

Summary of Judgment in the Mitsubishi Plastics Case (Judgment issued by the Supreme Court in December 1973, and all 15 judges of the Supreme Court agreed to it)

Articles 14 and 19 of the Constitution are solely intended to regulate the relationship between the State or a public body and an individual, and not to directly regulate the relationship between private persons.
An entrepreneur, in hiring workers for his own business, may, in principle, freely decide who to hire and under what conditions, unless there are special restrictions by law or otherwise, and even if an entrepreneur refuses to hire a person with a particular idea or belief for that reason, it shall not naturally be unlawful to do so.
It is not an illegal act prohibited by law for an entrepreneur to investigate a worker’s thoughts and beliefs when deciding whether to adopt or reject a worker, and to request a declaration from the worker on matters related to the investigation.
Article 3 of the Labor Standards Law is not a provision that restricts the hiring itself.
(2) In hiring new graduates, the right to terminate withholding the right to terminate with the purpose of reserving the final decision based on the investigation and observation at a later date, because at the beginning of the hiring decision, it is not possible to conduct the necessary investigation and collect adequate materials for the determination of the appellant’s qualifications, character, ability and other matters related to the appellant’s eligibility as a so-called management personnel.
I am of the opinion that a Supreme Court precedent is a law, and unless there is a precedent that overturns that precedent, that precedent must be protected as a law. I don’t know of any precedent that overturned this precedent after the Mitsubishi Plastics case, but why is the administration giving this kind of guidance while ignoring the Supreme Court precedent?

The basic human rights guarantee provisions of the Constitution are intended to be applied in principle to the relationship between the “state” and the “private person” and are not intended to directly regulate the relationship between private persons. However, I feel that there are many people who are asserting their rights by bringing the things that the state has to protect to private persons. It is very unfortunate that the recent social climate is one in which people at least fulfil their duties and are guaranteed their rights, and that they abandon their duties and insist only on their rights.

Professor Takehiko Aoyagi has even published a book titled “Too Much Personal Information Protection Will Destroy Japan”, and that is exactly what I think.
