裁判ってある意味面白い。

一般的かどうかは判らないが、裁判所では嘘を言ってはいけないと思っている人が多いのでは。

実は僕もその一人であった。ところが、昨年、自分が原告になって裁判を起こしてみて判った。 原告、被告は必ずしも真実を述べる必要はない。特に被告は、嘘の云い放題でも、結果的には何ら咎められることはない。

真実を述べると宣誓した「証人」は、嘘を云うと偽証罪に問われる事になるが、原告も被告も、 真実を述べると宣誓する訳では無く、何が本当なのかを争うのであって、嘘を言ったからと云って罰せられることはない。

そんな事は当たり前。今更、お前何を言っているのだ・・と笑われそうだが、裁判をしてみてあらためて実感した。

考えてみれば確かにそう。刑事裁判では、被告は「そんなことはしていない」「そんな覚えはない」と言い張り、真実と違うことを云いぱなしでも、その事で罪を問われる事は絶対にないのだから。 民事裁判も同じこと。

 

The trial is interesting in a way.

I’m not sure if it’s common, but I’m sure many people think you can’t tell a lie in court.

As a matter of fact, I was one of them. However, when I became a plaintiff last year and filed a lawsuit, I found out. Plaintiffs and defendants do not necessarily have to tell the truth. In particular, the defendant can lie as much as he wants, and consequently not be accused of anything.

A “witness” who swore to tell the truth would be charged with perjury if he told a lie, but neither the plaintiff nor the defendant swore to tell the truth.

That’s a given. People may laugh at me now, but after the trial, I realized once again what I was talking about.

If you think about it, it certainly is. In a criminal trial, the defendant can say “I didn’t do such a thing” or “I don’t remember such a thing” and never be accused of such a thing even if he or she says something that is not true. The same goes for civil trials.
