戸籍、住民票
先週3日間、火、水、木、と連続して業界団体の理事会があった。お陰で血圧が急上昇しお医者さんから大目玉を頂くに至った。
理事会の内容は何れも個人情報保護法及び戸籍住民票問題で議論奮闘、思いは一緒でもいざ行動となると意見百出。
総論賛成各論反対はどこの世界にでもある。業界の意見を一つにまとめるなどは至難の業であるが、
少なくとも今回の戸籍住民票問題では大道につき行動を起こさないと、業界は勿論、国民に取っても大変な禍根を残すことになると思う。
マスコミ報道によると法務省は9月20日、公開が原則となっている戸籍について原則非公開とするよう戸籍法を改正する方針を固めた。
また、住民基本台帳の閲覧、取得制限の検討にも着手するとある。戸籍、住民票の公開原則は、その必要性から頑なに守られて来たが、
今回これを改正し原則非公開にするという法改正である。
戸籍法第2章第10条（戸籍の謄抄本・記載事項証明） １．何人でも、
戸籍の謄本若しくは抄本又は戸籍に記載した事項に関する証明書の交付の請求をすることができる。２．前項の請求は、
法務省令で定める場合を除き、その事由をあきらかにしなければならない。３．市町村長は、
第１項の請求が不当な目的によることが明らかなときは、これを拒むことができる。４．第１項の請求をしようとするものは、郵便により、
同項の謄本、抄本又は証明書の送付を求めることができる。
このように現実には公開が原則にも関わらず、行政窓口は原則非公開とし、
他人の戸籍は理由を明らかにしなくても請求する事ができる弁護士や司法書士など８業種の有資格者が、
請求事由を詳細に記載して請求しない限りとれないいよう非常に厳しく制限し、住民票においてもほぼ同様の扱いをしている。
結果多種多様の弊害が出てきているがそんな事はお構いなし。唯ただ大きな圧力団体の言いなりに動かされている。
そこで現在の個人情報保護の流れと、戸籍住民票問題が一緒になると間違いなく大変な社会が出来上がる。履歴書などは１００％書き放題、
東大卒と書こうが京大卒と書こうがその時の気分しだい、職歴も大手上場企業や官公庁を書いておけば全てOK
（大手や官公庁ほど個人情報過保護法にして過敏になっている）、状況によっては生年月日も5歳位の誤魔化しは通用する、
現住所も郵便さえ受け取れる形にしておけばどこを書いてもOK。幾ら調査会社に依頼しても、学歴、職歴の確認さえできないし、
生年月日の確認も住所の証明もできない。
結婚に際しても同様で、過去何回結婚離婚を繰り返していても、本人が初婚と言えば初婚。単身赴任者が「俺独身・・」
と言えば独身で通用する、誰も確認できなくなるから。そして、悪いやつほどよく眠る・・的社会ができあがる。
企業間の取引、契約事で相手先の信用調査を否定する馬鹿はいないが、個人間の取引、契約事では調査そのものを否定し、
国が犯罪を奨励するかのごとき法改正を行わんとしている・・・。
会社の存在も、株式会社、有限会社、合資会社等の組織の如何に関わらず基本は法務局への登記であり、その登記内容は公開で、
誰でもが閲覧も交付請求も出来るシステムになっている。その為安心して取引が出来るのである。
ところが戸籍住民票が非公開になると個人間の取引では、相手が何処のだれか本人に聞く以外にしか確認の方法がなくなる。しかも、
本人が言う事を鵜呑みにするしかない。確認したくても住民票も取れなければ戸籍も取れない。
勤め先に確認しようと思ってもプライバシーを理由に応えてくれない。
詐欺師や人を騙そうとする人間は、特に世の流れを察知する事には目ざとい。何時でも自分が透明人間になれることを知ると、
何を考えるやら。思っただけでゾッとする。しかし、今の風向きからすると、そんな社会が目の前に来ているようだ・・・。
