日曜日、ゴルフの打ちぱなしで汗を流していると、携帯がブルル・・・・、「もしもし、お前、田中森一の反転読んだか・・」
突然兄からの電話である。「なに、それ・・」、「今話題の小説、止めケン（検事）の田中森一が書いた本だ」、「それがどうしたん・・」、
「直ぐ買って読め・・・、これは凄い、朝から首っ引き目が離せん。境遇的に相通じる所もあるし、久し振りに感動した・・」、
少し興奮気味の電話であった。

私は、兄とは一つ違い、所謂年子である。歳は違わなくても兄と弟は全く違う。とにかく兄貴というのは凄い、
ある意味親以上に怖い存在である。その兄の命令である、きかぬ訳には行かない。早速その足で本屋に向かい、大枚1700円をはたき「反転」
を購入。

直ぐに読み始めた、ところが仕事柄もあってか兄の受けた印象と少し違い、寧ろ反発を覚えるところさえある。弁護士たる者が・・・、
守秘義務は・・・等とつい思ってしまう。それにしても、裏社会の一部を垣間見る事ができる興味深い本であったことに違いは無い。

その中で、筆者田中森一は、「終章」と「あとがき」の中で書いているが、
獄中精神的に相当参っている時に友人から送られた一冊の本に救われたという。その本がなんと、
中村天風の講演録をテープ起こしした「成功の実現」であったという。
以後、中村天風に関する本を読み漁り、今では枕元に常時、中村天風の著作「真理のひびき」を置き、何時も寝際に読んでいるという。ただ、
筆者田中森一は中村天風の本を、単なる「自己啓発本」と捉え紹介しているように取れるところがあり、
その点は少し気に入らない。と云うのも実は、中村天風は50年の長きに亙って講演活動を行いながら、
自筆の本は殆ど残していない。それには、先生なりの深い考え方があり、真理の教えは「文章で書き表せれるものではない・・」との思いと
「本を読んで簡単に判ったと思われたら、逆に教えが仇になることがある（中途半端に勉強し判った気になっていると、
イザ事があった時にできず、出来ない自分が情けなくなり落ち込みがより一層深くなる）」との考えがあったようである。所が、
戦後周囲の強い要望から断りきれず、非売を条件に3冊の本を書いている。その本が、今「天風会」
の唯一の教材となっているが市販はされていない。本の題名は、「真人生の探究」
「研心抄」「錬身抄」で、所謂、天風三部作である。その他に「安定打坐考抄」があるが、何れも非売品である。可也難解な本であるが、
市販されている中村天風関係の本とは一味も二味も違う。市販されている天風関係の本は、天風会の会員やその周辺者が書いたものが全てで、
天風先生自らの著作で無い為、単なる自己啓発のハウツー本として読まれる傾向がある。

本当に中村天風直伝の「心身統一法」を勉強するには、各地に在る天風会員の集まる所に出向き、直接学ぶしか方法はない。

ＮＰＯ法人全国調査業協会連合会から会報発行に伴い投稿の原稿依頼があった。
「この忙しい時に・・」と言いたい所であるが、役目柄そうも言えない。そこで、眠たい目を擦りながら、
昨夜その原稿を書いた。折角書いたからには会報だけではもったいない。そこで嫌々ながら、今週のブログは、その原稿を添付することにする。
決して手抜きではない。ただ、物は常に有効に活用をしなければいけないと思うから・・・・。

「業界を取巻く環境」

調査業界を取巻く環境が今ほど厳しかったことは無かったのではないか。全般の景気は東京を中心に回復基調にあり、
地価は既にミニバブル現象を呈しているとさえ言われる程であるが、我が調査業界はここ十数年下降の一途をたどり、
浮上の兆しは全く見られない。その上、下降に拍車をかけるかの如く、消費者保護法、個人情報保護法、
住民基本台帳法及び戸籍法の一部改正と法の網がかけられ、そして今年6月１日には
「探偵業の業務の適正化に関する法律」（探偵業法）がスタートした。業界の一部には、この探偵業法施行を「待ちに待った慶事」
ととらえている所もあるようであるが、業法の内容は、検討すればする程その厳しさに驚かされる。立法趣旨は
「依頼者と被調査人の保護」にあり、業者の育成は微塵もない。主務官庁は公安委員会で、実務は都道府県警が行う事となっている。
所謂、調査業界を警察の管理下に置き、業界の実態把握と消費者保護と被調査人の保護に努めようというのである。そして、
実際の調査の現場には、人権の視点と個人情報保護の網をかけ、調査そのものを非常に難しいものにしている。
長年調査業界に身を置き、依頼者の為に日夜汗してきた者からみると、今ひとつ釈然としないものを感じる。
依頼者保護の一番の眼目は、料金も去ることながら調査の中味ではないでしょうか。幾ら低料金でも調査内容が貧弱であれば、
結果的には非常に高いものにつく。逆に、少々料金が高くても調査内容が依頼主旨に沿ったものであれば結果的には安いものにつく。
ところが、法律は依頼者保護を主眼としながら、実際の調査現場を、
人権と個人情報保護による規制で非常に難しいものにしている。 何らの権限も与えられず厳しい法規制の枠の中で、
依頼者が納得する調査を実施しなければならない。「調査員の苦労や如何に・・」 との感が強い。ただ、業法は施行したばかりで、
実際の運用はこれからである。3年後の見直しを見据えて、
じっくりと研究して行かなければ成らないと考えている。

「21世紀は人権の世紀」
と言われるが、人権を論じる難しさ、人権を論じる恐さ、人権が人権を踏みにじる矛盾、日本国憲法では
「人権は国民の不断の努力によってこれを保持し、濫用してはならない」としているが、実際には人権のはき違えから、
個人の大権のような使われ方をしている。また、個人の権利意識が錦の御旗の如く使われ、「個人情報保護法」などは、
法律の趣旨に関係なく、「個人情報は全て本人の承諾なくしては取得してはいけない」かの如く解釈し、
個人の事を調べるのは良くないこと、と全く訳の分からない事を言い出す人権論者が大手を振るに至っては、今は「世も末」
と嘆くしか打つ手がないようにさえ思える。ただ、揺り戻しが必ず来ることを信じて、今は忍の一字で耐えるしかないのかも。
