毎年の事ながら、この時期になると会報誌の原稿を提出せよとのご下命が、業界の事務局よりよせられる。そこで、無い頭を絞りながら考えるのだが、結果は何時ものボヤキ節に成ってしまう。それでも、マッちゃんのボヤキがないと会報にならないと慰めてくれるお人も居るので、今年も懲りずに書きました。一読あれ・・・、そしてご意見が頂ければ、それこそ幸いです。
「調査と個人情報」 松谷 廣信
新年明けましておめでとう御座います。会員の皆様方には清清しい年を迎えられたこととお喜び申し上げます。今年は巳年とか、巳は神の使者、行いが良ければ神は必ずご褒美を巳に託してくれるはず。それを信じて、今年一年、会員一丸となって善行に努めましょう・・・。
それにしても昨年は業界に取って大変な年でしたね・・。各種情報の不正取得が司直の手を煩わせる事となり、業界関係者と思われる人の名前が新聞紙上に見られた事も１度や２度で無く、明日は我が身と心細く感じられた人も居たのでは無いでしょうか。
そこで今一度、「調査と個人情報」について考えて見る事にしました。
私ども組合員の仕事は、大半が探偵業法でいうところの調査業務に当たり、「他人の生命、身体、財産のために必要な人の所在又は行動に関する事項について、当該他人の需要に応じて調査し、その結果を当該他人に報告する業務」に該当しているものと思われます。そして、その調査には、個人情報は必要不可欠なものであり、言い換えると、個人情報の入手そのものが探偵業務であると言っても過言ではありません。
ところが、個人情報法保護法が施行されて以後、個人情報は本人承諾無くしては、他人が入手してはいけないもの、と一般的に解釈されている様で、業務に着手する毎に、「それは個人情報ですから・・」「そんな個人の事は・・」など、他人の事は調査してはいけないかの如く、お断りの言葉を耳にするのが当たり前の事となっています。ところが、一方何か事があると、「よく調べてみます・・」「再度調査をして・・」と、何か正確をきそうとすると、「調査をして」との言葉が、これまた当たり前の事となっています。
所謂、調査は物事を判断する上での大きな役割を担い、一般的には、商取引の祭の法人・個人の信用調査、結婚や就職の際の人物調査、夫婦関係や交際相手の素行調査（異性、経歴、金銭等を含む）、会員倶楽部等への入会審査の調査など種別は様々ですが、一様に信用度、信頼度を客観的事実（調査）を持ってはかろうとするものであります。
人生８０年、一生に１度や２度は、誰でもが被調査人の立場になったり調査依頼人の立場になる可能性を持っており、非常に身近な問題と言えるのではないでしょうか。
しかし、一般的に人は、被調査人の立場で物を考え、意外と依頼人の立場で考えることはしない様です。被調査人と依頼人とは全く立場を異にし、知りたい立場と知られたく無い立場に別れ、立ち位置によって調査に対する考え方も大きく違ってきます。しかし、現代の日本は、戦後アメリカの占領政策による日本弱体化政策の恩恵を受け、個人主義の思想が蔓延し、弱い立場の人が主張する事が、民主的で正当な考え方の様に捉えられ、政治家は大衆迎合一辺倒で、１００年の計を持って天下国家を考える様な国士的人材は数少なくなっています。そんな事に起因してか、調査に対する考え方も、調べられる立場、知られたく無い立場から見た考え方が優先し、知りたい立場、調べる立場からの考え方は余り取り上げられる事が有りません。
個人情報保護の考え方も極めて一方的で、今では個人の情報は全て本人に帰属し、本人承諾無くしては何一つ取ることが出来ないかの如く考えられています。
個人情報保護法は決してその様な法律ではなく、個人情報の有用性に配慮しつつ、５千件以上の個人情報をデータベース化（個人情報を容易に検索することが出来るように体系的に構成したもの）し、それを業務の用に供している者を「個人情報取扱業者」と定め、この個人情報取扱業者に規制をかけ、現在のコンピューター社会での個人情報の大量流出と不正使用や目的外使用を無くし、個人の権利利益を保護する事を目的としてつくられた法律にも関わらず、「個人情報過保護法」と揶揄されるまでに拡大解釈され、結果、就職の際の履歴書が正しいか否か、その確認さえ不可能で、履歴は書き放題、職務経歴は言い放題の非常に歪んだ社会が構築されようとしています。調べる事が悪としたら何が本当か分からなくなる。本人申告を確認する事が出来ないとしたら、勝手な申告のし放題である。それを知っている行政官は、自分らは特権により、その確認が出来るようにしているが、民間にはそれを規制し、「何が真実か・・」を調べる権利を取り上げている。戸籍も住民票も非公開、学校は卒業確認に応じない、行政も企業も在籍紹介に応じない、データー化されている個人情報の入手は不可能。これ全て、個人情報保護法が施行されて以後の現象である。
そんな事を知ってか知らずか、弊社で扱う履歴書や職務経歴書に３０％強の虚偽記載が発覚しており、中には学歴、職歴の全てを詐称し、正しいのは名前と年齢だけなどと云うのもあれば、住所も年齢も虚偽申告している人さえいる。しかし、それが判明するのは、ベテラン調査員が塀の上を歩きながら調べた結果であり、素人が自ら調べようしても今の社会制度では何一つ判らないのでは無いかと思われる。
極最近の出来事であるが、弊社に一部上場の某企業から採用調査の依頼があった。被調査人の履歴書たるや、一見して超エリートと思わせるもの。
○年○月開成高校卒業、同時に東京大学法学部入学、ストレートで同大学卒業。同年４月大蔵省入省、同年９月ハーバード大学法科大学院入学（国費留学）。３年後同大学院卒業、帰国し大蔵省退省。三菱商事に就職、４年後にヘッドハンティングで帝国ホテルに就職、３年後再度ヘッドハンティングにより東京ガスに就職。思うところあり３年の勤務を経て独立、以後、外務省の支援業務（通訳）に従事し現在に至る。しかも、申告の職務経歴書たるや物凄い実績で、会社貢献度抜群の記述となっていた。
一見、世の中にはこんな凄い人も居るのだな・・、そんな印象を持たせる履歴書であった。しかも、依頼先は一部上場企業。聞けば、社長面接まで済ませ、一応合格ラインにあるとのこと。従って、申告履歴に大きな相違が無ければ、即戦力の管理職ポストでお迎えしたい意向、との事であった。
ところが、調べてみると、この履歴は全くのデタラメ。学歴も職歴も全て詐称で、本当は関西の府立高校を何とか卒業はしたものの大学受験に２度失敗し、以後フリーターとして転々と職場を変わり、結婚もせず未だ親の脛を齧る甘ちゃんで、４０歳余になる今まで正社員での勤務経験を持たない御仁であった。
就職の際の履歴書がそうなのだから、彼女や彼氏を口説くさいのバックグラウンドなど押して知るべしといえなくも無い。ところが厚生労働省が後生大事に毎年発行している「採用と人権」等の冊子によれば、採用時の調査等はもっての外と云った感じで、身元調査イコール差別と決めつけ、悪の権化のようなニュアンスで書かれている。だいたい身元調査の用語の定義も持ち合わせず、身元調査と言う言葉を平気で漫然と使っている（以前、会議の場で労働部の行政官に「身元調査」の定義を問うたが、答える事が出来なかった）。
そんなこんなで、「調査と個人情報」に関し、日頃の思いを書き始めれば切りがないが、紙面も限られているのでこれくらいとするが、組合員の皆様、今年はこんな問題もお互いに勉強し議論を深め、社会に対し主張すべきは主張し、ひいては日本の良き文化を継承する社会構築に貢献しようではありませんか。

This year is the year of the snake, the snake is God’s messenger, and if we do well, God will surely give a reward to the snake. Believing that, let’s make a concerted effort to do good this year….
By the way, last year was a very difficult year for the industry… It was not once or twice that the name of the person who was thought to be related to the industry was seen on the newspaper.
So, I decided to think about “research and personal information” once again.
The majority of the work we do as members of our association falls under the category of investigative work as defined in the Detective Business Act, which is “the business of investigating the whereabouts or activities of persons who are necessary for the life, body, or property of others in accordance with their needs, and reporting the results to them. In other words, it is not an exaggeration to say that the acquisition of personal information itself is detective work.
However, since the Act on the Protection of Personal Information was enacted, personal information has been generally interpreted as something that cannot be obtained by others without the consent of the individual. As a matter of course, it has become the norm to hear a refusal to investigate other people’s personal information, such as, “That’s personal information. However, on the other hand, when something happens, “I’ll check it out” or “I’ll check it out again” or “I’ll check it out” or “I’ll check it out again”, when we try to get something accurate, “Please do a survey” has become a matter of course.
In general, there are various types of investigations, such as credit checks on corporations and individuals for business transactions, character checks on marriage and employment, background checks on married couples and partners (including the opposite sex, background, money, etc.), and examinations of membership in member clubs, etc. However, they all have objective facts (investigations) to assess the level of trust and confidence.
In 80 years of life, once or twice in a lifetime, everyone has the possibility to be in the position of an investigator or an investigator’s client, so it is a very familiar issue.
However, in general, people seem to think from the standpoint of the person being investigated, and surprisingly do not think from the standpoint of the client. The researcher and the client are in completely different positions, and the position they want to know and the position they don’t want to be known are different. However, modern Japan has benefited from the post-war American occupation policy to weaken Japan, and individualism has become widespread, and what the weakest person can say is considered democratic and legitimate. Perhaps because of this, the way of thinking about investigations gives priority to the way of thinking from the standpoint of being able to investigate or not wanting to know, and the way of thinking from the standpoint of wanting to know or investigating is rarely taken up.
The idea of protecting personal information is also extremely one-sided, and now it is considered as if all personal information belongs to the person in question, and nothing can be taken without his or her consent.
The Personal Information Protection Law is not such a law at all. The law was created for the purpose of protecting the rights and interests of individuals and eliminating the mass outflow of personal information in the current computer society and its unauthorized use and use for other purposes. If it’s evil to look into it, it’s hard to know what’s real. If you can’t confirm your own declaration, you are free to make your own declaration. Administrators who know this are allowing themselves, by their own privilege, to verify it, while the private sector is regulating it and taking away the right to find out “what is true … It is impossible to obtain the personal information that has been made into a data that neither the family register nor the residence certificate is private, the school does not respond to the graduation confirmation, the administration nor the company does not respond to the enrollment introduction. All of this has happened since the Personal Information Protection Law was enacted.
Some of them misrepresent their education and work experience, some say only their name and age, and some even falsely declare their address and age. However, it was found that the results were obtained by a veteran researcher walking on the fence, and even if a layman tried to investigate by himself, he would not be able to find out anything under today’s social system.
Recently, we received a request from a company that is listed on the First Section of the Tokyo Stock Exchange to conduct a recruitment survey. At first glance, the resumes of the investigators appear to be those of the ultra-elite.
He graduated from Kaisei High School and entered the University of Tokyo’s Faculty of Law in October of the same year. He entered the Ministry of Finance in April of the same year and Harvard Law School in September of the same year (government-sponsored study abroad), graduating three years later. After four years, he was headhunted to work at the Imperial Hotel, and three years later, he was headhunted again to work at Tokyo Gas. After working there for three years, I became independent, and since then, I have been working as an interpreter for the Ministry of Foreign Affairs. In addition, the work history of the declaration was a great achievement, and the description of the contribution of the company was outstanding.
Moreover, the client is a listed company. When I asked him about it, he told me that he had already interviewed for the president of the company and that he was in line to pass. Therefore, as long as there were no major differences in his filing history, he would like to welcome him in a managerial position with immediate workforce.
However, when I looked it up, this history is complete bullshit. His academic background and work experience were all false, and in truth, he had graduated from a prefectural high school in Kansai, but had failed the university entrance examinations twice, and since then he has been a freelancer, changing jobs, never getting married, and still gnawing at his parents’ shins.
It’s like a resume when you get a job, so it’s important to know the background of how to hit on your girlfriend or boyfriend. However, according to the “Recruitment and Human Rights” booklet published every year by the Ministry of Health, Labor and Welfare, it says that investigations at the time of hiring are not necessary, and the booklet assumes that background checks are discriminatory, with a connotation of vindication. They don’t even have a definition of the term “background check” and use the word “background check” indiscriminately (I once asked a Labor Department official at a conference for a definition of “background check”, but he couldn’t answer).
This year, let’s study and deepen our discussions on these issues, make our arguments to society, and contribute to the building of a society that inherits the good culture of Japan.
