弊社は、お盆を中心に前段、後段と２班に分かれて数日前から夏季休暇に入っている。従って、社員は半数しか出勤していない。すると、不思議なもので、出勤しても何となく休みムードが漂い、何時もの張りが感じられない。こんなだと寧ろ皆揃って休んだ方が良いのかも・・・等と思うが、これも小規模なサービス業会社の辛い所で、得意先が営業しているのに休む訳にはいかないでしょう・・・、とつい思ってしまう。

本当はそんな事もないのだが・・・・。

それはそうと、台風４号が心配。我が故郷、隠岐ノ島を直撃しそうである、しかも可也の勢力を保ったままでだ・・。実は、小生の友人が2泊3日の隠岐旅行を計画。その為、田舎の友人知人にも連絡し、良しなに計らって貰うよう色々段取りをしていたが全てパー、トホホ・・・・。台風に向かって突っ込む訳にも行かず、今日出発の予定であったが急遽キャンセルと相成った。

ホテルの予約など、全て小生が手配していたので仕方ない、朝一番にキャンセルの電話を入れた。

「誠に申し訳ありませんが・・・・・」、すると、「イヤイヤ良いですよ・・・、自然には逆らえませんは・・・又の機会によろしく」、何ともあっさりと気持ちよく承諾してくれた。しかも、キャンセル料のキャの字も云わない。2軒が2軒ともである・・・。

ほんとにこれで良いの、と思ったが、その好意に素直に甘えることにした。それにしても何て隠岐の人はこんなに素晴らしいのだろう・・・、申し訳なさと感謝で小さな小生の胸はいっぱいになった。

この事で思い出したのが7年ほど前の出来事。多分平成14年9月であったと思うが、娘が大学生の時、単独で屋久島への小旅行を計画。ところが今日と同じく大型台風が屋久島めがけてゆっくりと北上している。娘は不安を持ちながら大阪空港へ、すると空港で「鹿児島までは飛びますが、鹿児島から屋久島へは何とも云えません、それでも良いですか・・・」とのこと。流石に娘もそこで不安になり、鹿児島で足止めになっても、との思いから急遽キャンセル。

直ぐに屋久島の民宿にも電話を入れ、詳細に事情を話し、キャンセルをお願いしたらしい。

すると、数日後にその民宿の小父さんから娘に宿泊料１００％の請求の電話・・・、娘は今ひとつ納得行かず、値交渉を気弱な声でしたらしい。ところが小父さんは全く聞く耳を持たない。「直ぐに振り込んで下さい」の一点張り。でも、娘は納得が行かずほったらかしていた、、、。すると日々催促の電話が屋久島から入る。で、何回目かに小生が変わりに応対。「台風で飛行機が飛ぶか飛ばないか、しかも鹿児島まで行ってからでないと判らない・・・、そんな状況で、観光旅行を強行しますか。事情が事情なのだから当日キャンセルは１００％と云われるの少し酷ではないか・・・、しかも学生の1人旅・・・」、切々と情に訴えるが、その小父さん全く聞く耳なし。

こりゃダメだ・・・。娘に直ぐに払うよう云い、処理をした事があった。

その時、小生は思った。屋久島には絶対に行かないと。小父さんは、損して得を取る、と云う言葉を知らなかったのかな・・・。

Our company has been on summer vacation for a few days, divided into two groups, one in the front and one in the back, around the Obon Festival. Therefore, only half of the employees show up for work. Then, strangely enough, even when I went to work, I felt a mood of rest for some reason, and I didn’t feel the same tension as usual. This is also the hard part of a small service industry company, and it is not possible to take a day off when the customer is in business, I think.

The truth is, it’s not like that…..

By the way, I’m worried about Typhoon No. 4. My hometown, Oki-no-jima, is about to be hit directly, and moreover, it is still maintaining a certain amount of power … Actually, a friend of mine planned a 2-night/3-day trip to Oki Island. Therefore, I contacted my friends and acquaintances in the countryside, and made various arrangements to have Yoshina measure me, but it was all par, to-ho…. It was not possible to run into the typhoon, so we were scheduled to leave today but had to cancel in a hurry.

I called the cancellation first thing in the morning, because I had arranged all the hotel reservations and so on.

I’m sincerely sorry, but …”, then, “I’m sorry, but …”, “I’m sorry, but it’s good … I can’t go against nature … I’ll take another chance. In addition, they don’t say the word of the cancellation fee, and two houses are both houses…

I thought that this was really all right, but I decided to give in to the favor. By the way, how wonderful the people of Oki are……………………………………………………………..

This reminded me of something that happened about seven years ago. I think that it was probably September 2002, but when my daughter was a university student, I planned an excursion to Yakushima alone. However, as today, a large typhoon is slowly moving northward toward Yakushima. She went to Osaka airport with anxiety, and then she was told at the airport, “We fly to Kagoshima, but we don’t know how to go from Kagoshima to Yakushima. As a matter of fact, my daughter became anxious there and cancelled the trip in a hurry because she thought that she might get stuck in Kagoshima.

He immediately called the guest house in Yakushima, told them the details of the situation and asked them to cancel.

Then, the phone call of the claim of the lodging charge 100% to the daughter from the father of the inn a few days later …, it seems that the daughter did not go convincingly one more, and the price negotiation was a timid voice. But my father doesn’t listen to me at all. Please transfer the money immediately”. But she didn’t agree and left it alone… Then the phone call of the demand comes in from Yakushima every day. Then, I answered the question for the second time. I don’t know if the plane will fly or not because of the typhoon, and I don’t know until I go to Kagoshima… Do you want to go on a sightseeing trip under such circumstances? I was a student traveling alone…” I appealed to his father earnestly, but he didn’t listen to me at all.

That’s not good… I once told my daughter to pay it off right away and I took care of it.

At that moment, I thought to myself. I have to go to Yakushima for sure. Didn’t your uncle ever know the phrase “lose and gain”…

先週、金・土・日と３日間、香里天風会の夏期特別研修会に参加、無事修練を終えることが出来た。
従って、今週はその余韻で、「心身ともに極めて充実」と宣言したいところだが、
寄る年波には勝てず、と云うか、心は元気モリモリなれど、身体は、盛夏の中、
クーラーなしで過ごしたためか、腕と首にあせもが発生し中々直らない。多分田舎（隠岐ノ島）に帰り、
子供の時の様に海で過ごせば直ぐに治るであろうが・・・。

帰りたいナー・・・隠岐ノ島。

そういえば、物心がついた頃から小学校６年頃までは夏休み４０日間は、
朝から夕方まで、殆ど海の中で生活していた。海に長くつかりすぎると唇が紫色になってくる、すると上級生から、「陸に上がれ」と叱られる、
で、陸に上がるが、本当はしぶしぶである。そこで子供心にも一工夫する。真夏の太陽で熱々に成っている小石を拾い、唇にあてる、
すると唇は直ぐに赤くなる。赤くなればもうＯＫである、また海に飛び込む。その海と小石のキスを延々と繰り返す。
飽きもせず４０日間毎日同じことの繰り返しであった。でも楽しかったな・・・・。

何でこんな事を書き出したのかよく判らないが・・・まーいいか。そうー、少々の事は「まーいいか」精神で、
おおらかに遣りたいものだ。

Last week, I participated in the special summer training session of the Kori Tenpukai for three days, Friday, Saturday and Sunday, and was able to finish the training without any problems.

Because I spent the day without a cooler, I got bruises on my arms and neck and they don’t heal easily. Probably back in the country (Oki-no-jima).
If I spent time at the sea like I did when I was a child, I would be cured soon…

I want to go back…Oki-no-jima.

Come to think of it, from the time I was very young until I was in my sixth year of elementary school, I had 40 days of summer vacation.
They lived in the sea most of the day, from morning to evening. If you stay in the sea too long, your lips will turn purple, and you’ll be scolded by a senior to “get on land.
So, we went on land, but reluctantly. So, I’m going to give it a shot in the kid’s mind. Pick up a pebble that’s hot in the midsummer sun and put it to your lips.
Then the lips immediately turn red. When it turns red, it is ready to jump into the sea again. The sea and the pebbles kissed endlessly.
He did the same thing every day for 40 days without getting tired of it. But it was fun…..

I’m not sure why I wrote this out…well, whatever. Yeah, I’m just trying to keep a little bit of an “okay” mentality.
I want to be generous.

財団法人天風会香里賛助会の夏期特別研修会が、今週末、７月３０・３１日、８月１日の３日間の予定で開催される。

この夏期特別研修会（修練会）と云うのは天風会員に取って１年最大の行事であり、万難を排し参加するのが務めである。否、
務めと云うのではなく、参加せずにおられない位の気持ちを持って集まって来るのがこの修練会である。

しかも、香里が主催する修練会は今年で４１回目。ただ、この伝統ある香里の修練会ももしかしたら今年で最後かも（道場の問題・・）
との思いもあり、今年は特に力が入っている。

ご指導頂く先生は、尾身幸次（天風会理事長、元財務大臣）、南方哲也（天風会教務主任、元大学教授）、稲松信雄
（天風会講師、元大学教授）と、天風会のエースにお越し頂く事になっている。

The special summer training session of the Tenpukai-Kori Support Society will be held this weekend, July 30 and 31 and August 1.

This summer special training session is the biggest event of the year for the members of the Heavenly Pond and it is their duty to participate in it. Nope.
It’s not just the duty of the participants to attend, but to come together with the feeling that they are not alone.

Moreover, this year was the 41st training session held by Kari. However, this traditional training session in Kori might be the last one this year…
This year, we’ve put a lot of effort into it.

The teachers are Koji Omi (President of Tenpukai, former Minister of Finance), Tetsuya Minakata (Chief of Academic Affairs of Tenpukai, former professor) and Nobuo Inamatsu.
We are going to have an ace of the Tenpukai and a lecturer of the Tenpukai (former university professor).

先週、祇園祭りの初日、京都の八坂神社に島根の石見神楽が奉納された。これは京都島根県人会が何年来続けている神楽奉納で、小生にも「一度視に来ないか？」との案内が京都島根県人会よりあり、喜んで妻と2人お招きに預かった。

石見神楽の期限は定かではないが、平安末期から室町時代に形作られた大元神楽が原型といわれ、江戸時代中期ごろ演劇化され、神職による神事として行われていたものを、明治維新の神職演舞禁止令により、土地の人に受け継がれ、今に至るとされています。

石見神楽の里と云われる浜田市には４８以上もの社中と呼ばれる団体があり、石見神楽の伝承と保存に努めているそうですが、それはそれは勇壮華麗な見事な舞であった。

出し物は、鈴神楽、天神、黒塚、恵比寿、鐘馗、大蛇で、夕方6時半?9時半まで３時間の大熱演であった。

Last week, on the first day of the Gion Festival, Shimane’s Iwami Kagura was dedicated to Yasaka Shrine in Kyoto. This is a kagura dedication that the Kyoto Shimane Kenjin Association has been doing for many years, and even I was asked, “Why don’t you come and see it once? My wife and I were delighted to be invited by the Kyoto Shimane Kenjin Kai.

It was dramatized around the middle of the Edo period and was performed as a ritual by priests, but it was handed down to the local people by the Meiji Restoration order prohibiting the performance of priests.

In Hamada City, which is called the village of Iwami Kagura, there are more than 48 organizations called “company chapters” that are trying to preserve the tradition of Iwami Kagura.

The performances were Suzu Kagura, Tenjin, Kurozuka, Ebisu, Shoki the Shogun, and the Great Serpent, and it was a great enthusiastic performance for three hours from 6:30 to 9:30 in the evening.

私の周辺で訴訟問題が起きた。直接ではないが身近な人で、しかも当人は身に覚えはあるが訴訟事件になるなど全く思いもしなかったこと。そこで、小生に相談を持ちかけて来た。ところが私は調査のプロではあるが法律は門外漢。

法律は、社会生活を営む上での最低限のルールであり、ある程度の社会常識と道徳観念さえあれば、裁判など無縁のものと心得ており、日々の生活は自分の感覚で判断し、法的に云々など殆ど考えもしない。被相談者も私同様で、自分也の常識で、何らの悪意も無く行った行為が、今回の訴訟事件と云う訳である。

アメリカは、訴訟社会と云われ、法曹界に係わる人は非常に多く、弁護士の数も日本の数倍は居るようであるが、法曹人が多いから、事件が少ないかと云えば、そうでなく、平穏な社会かと云えば、そうでもなく、犯罪も訴訟事件も日本の数倍は起きている。これって、一寸おかしいと思いませんか・・？。平穏で安心して暮らせる社会にを願って法律を作り、その法を守る為に、法曹人は居ると思うが、その関係者の多さに比例して訴訟事件も多くなっていくようである。

　私が師事する中村天風先生の講演録の中にも似たような話しがあった。先生は、明治、大正、昭和と生きた人である。昭和３０年代当時のお話、「戦前は今と比べ、医者の数も病院の数も極めて少なかった。ところが戦後、西洋医学がもてはやされ、医者の数も病院の数も数倍に膨れ上がり、しかも、病院が赤字など聞いたことがない。病気を治す為の医者や病院が数倍になり、しかも赤字でないと云う事は、病人の数が数倍に増えていると云う事である・・・」云々と。

所謂、世の矛盾をついたお話しであるが、いいえて妙。法曹界でも、今回の相談を受け、結構同様の事が起こりつつあるのでは無いかと感じた。

実は、訴訟を起こされると受けなければならない。原告の言い分に反論しなければ、原告の訴えがそのまま通ってしまう。ところが、普通の小市民は裁判などした事がない。答弁書を書こうにも、何をどう書けば良いのかよく判らない。そこで、弁護士さんに相談に行く。すると、相談料が必要となる。で、結果は、自分１人では難しいとの判断になる（９９％がそうだと思う）。そこで、弁護士さんにお頼みすると、簡単な事件でも着手料３０万円。その上に、交通費、諸経費、結果報酬が必要となり、少なくとも５０万円くらいは覚悟しなければならない。

５０万円は小市民にとっては大金である。ところが、自分が何の罪の意識も無く、自分の常識で極普通にした事が、ある日突然告訴され、結果勝っても５０万円くらいは覚悟しなければならない。そんな訴訟社会が目前に来ており、私の周辺でも、「エッそんな事で・・・」と驚くばかりの訴訟が提起され、これから戦わなければならい事になっている。全くもってトホホ・・・である。その内に、名誉毀損などの損害賠償訴訟を商売にする様な人物が現れ、「訴訟で儲ける方法・・」などと云う、本が出版されるかも・・・・？。

戦後アメリカによる日本弱体化政策がボディブローのように功をそうし、国や社会は二の次、義務などは眼中に無く、個人の権利利益のみを主張する、全く嫌な訴訟社会が目の前にチラついて来た。こんな社会は天国から眺めることにしようかな・・・・。

本年６月の文芸春秋に「日本国民に告ぐ」と題して、藤原正彦氏（御茶ノ水女子大教授、数学者）が出稿しているが、よくぞここまで書いてくれた、と深く感動した。藤原氏は「国家の品格」を著し、品格ブームを起こした人とであるが、私は今の日本では最高の文化人だと確信し崇拝している。

Litigation issues have arisen around me. It was a person who was not directly involved in the case, but was close to the person, and he or she had no idea that the case would become a lawsuit, even though he or she remembered it. So, he came to me for advice. However, although I am a professional investigator, I am not an expert in the law.

As long as I have a certain amount of social common sense and a sense of morality, I don’t need to go to court. I judge my daily life based on my senses and hardly think about legal issues. The reason why this case is a lawsuit is because I acted without any malice in my own common sense and without any malice.

The U.S. is a litigious society, with a large number of people involved in the legal profession and several times as many lawyers as Japan. Don’t you think this is a little strange? It seems that the number of legal cases is increasing in proportion to the number of people involved in the lawsuit.

There was a similar story in a lecture by my mentor, Tenpou Nakamura. He was a man who lived in the Meiji, Taisho, and Showa periods. He said, “Before the war, the number of doctors and hospitals was extremely small compared to today. After the war, however, Western medicine became popular, and the number of doctors and hospitals ballooned several times. The number of doctors and hospitals used to treat the sick has increased several times over, and the fact that they are not in the red means that the number of sick people has increased several times over…

It’s a story of contradictions in the world, but no, it’s strange. I felt that the same thing was happening in the legal field as well, after receiving this consultation.

In fact, if a lawsuit is filed, it has to be accepted. If you don’t rebut the plaintiff’s argument, the plaintiff’s complaint will go through as is. However, ordinary petty citizens have never been on trial. I’m not quite sure what or how to write a written response. So, I went to consult with a lawyer. Then, a consultation fee will be required. And the result is that it’s difficult to do it on your own (I think 99% of them do). So, if you ask a lawyer, even if it is a simple case, the start-up fee is 300,000 yen. On top of that, you need to be prepared to pay for transportation, overhead and results, at least 500,000 yen.

500,000 yen is a lot of money for a small citizen. However, what I did without any sense of guilt and with my common sense was suddenly prosecuted one day, and even if I won, I had to be prepared for about 500,000 yen. Such a litigious society is just around the corner, and there are many lawsuits being filed around me, and I have to fight against them. I’m so happy…. Maybe one day, someone will appear who will make a business out of suing for damages, such as defamation, and a book will be published that says, “How to make money from lawsuits…”…

The post-war US policy to weaken Japan has worked like a body blow, and the country and society have come to see an utterly disgusting lawsuit society that insists only on individual rights and interests, not on obligations. I guess I’ll just have to watch this society from heaven…..

Mr. Masahiko Fujiwara (mathematician and professor at Ochanomizu University) wrote an article titled “A Message to the Japanese People” in the June issue of Bungei Shunju, and I was deeply moved that he had done such a good job of writing it. Mr. Fujiwara is the author of “The Dignity of a Nation” and the man who caused a boom in dignity.
