個人情報保護の壁

今年も早々に業界団体の会報原稿依頼が来た。さて何を書こうかとデスクに向かう。年明けの少しボーっとした頭に浮かぶのは、常時頭の隅から消えることの無い、プライバシーとか個人情報の問題。過去にも何回か書いたような気がするが、またまた今回も同じようなことを長々と書いてしまった。

 

個人情報保護の壁

 新年あけましておめでとうございます。協会員の皆さまはどんな正月を迎えられたでしょうか。

 今年、関西の年明けは小春日和を思わせる穏やかな日よりとなり、晴れ晴れとした気持ちで新年を迎えることができました。皆様にとりまして今年一年が、この年明けのような爽やかな気持ちで過ごせますよう願わずにはいられません。

 さて、表題の個人情報ですが、今一般的には「個人情報は本人の承諾なくしては、他人に漏らしてはいけない」と理解されているようで、個人のことを尋ねると、「いや、それは個人情報ですから言えません」、中には「それは個人情報でしょう、そんな事を調べていいんですか?」などと云われ、うさんくさそうな目で見られる。これが現実では無いでしょうか。

しかし、社会を構成するのは人一人ひとりであり、人が集まってコミュニティーが形成されています。しかも、人が人と付き合い、友達になるのも喧嘩するのも、人と人の関係性のぶつかり合いである。そんなこんなを色々考えていると、非常に素朴な疑問が沸いてきます。

人は、相手のこと(個人情報)を知らずしては、安心して付き合うことはできない。しかし、個人のことを尋ねると「個人情報ですから・・」との答えが返ってくる。ところが、会話の大半は人に関する事ではなかろうか。市井の奥様方は井戸端会議で、「それは個人情報ですから・・」などと云おうものなら、すぐに村八分、グループから外されてしまうのでは・・。特に女子会などは、人の話題(個人情報)で花が咲き、コミュニティーが成り立っているのでは。

個人情報云々が大きく問題にされるようになったのは、平成15年の個人情報保護法なる法律が施行されてからである。ただ、この法律に、「個人情報は、誰しも本人の承諾なくして漏らしてならない」などと書かれているのであろうか?。全く、否である。

個人情報保護法の目的は、「個人情報の有用性に配慮しつつ、個人の権利利益を保護することを目的とする」とあり、個人情報とは「生存する個人に関する情報で、特定の個人を識別することができることとなるもの(氏名、生年月日など)をいう」とある。その上で、特定の個人情報を電子計算機を用いて検索することができるように体系的に構成したもの。また、特定の個人情報を容易に検索することができるように体系的に構成したもの」と定め、この情報を「個人情報データベース等」として、個人情報データベース等を事業の用に供している者を「個人情報取り扱い業者」と定め、この個人情報取り扱い業者を対象に、個人情報の取り扱いを定めたものがこの法律である。

所謂、個人情報を電子計算機等を使って容易に検索できるようにし、それを、事業の用に供している事業者を対象として定めた法律である。そして、この法律の対象となる「個人情報取り扱い業者」が個人情報を収集し、それを利用する場合には、収集目的以外の事に使ってはならない、使う場合は本人の承諾を得なければならない、などと細々と規制されている。

これは、国民一人ひとりを対象とした法律ではなく、個人情報を大量に収集する、「個人情報取り扱い業者」をターゲットとした法である。従って、「彼、彼女が、今どこに住み何をしているか、何歳でどんな人か」など、個々人の責任において話す分には何ら科(法律の規制)を受けるものでは無い。もし、そんな法律であれば、人は社会生活を営むことはできず、コミュニティーは成立しない。にも拘わらず、「それは個人情報ですから・・」と云えば、寧ろコンプライアンス精神を強く持った立派な人の様に思われると思ってか、何かいうと「それは個人情報ですから・・」と、いかにも知った顔でのたまう御仁が多い。

 個人情報保護法が何時からこういう事になったのであろうか・・?。

 弊社は、採用時の事前調査を主に行っており、応募者の提出した履歴書及び職務経歴書を基に、その履歴や職務経歴が正しいか否か、前職での勤怠や職務能力がどうであったのか、また、人柄や素行はどうなのかなどを調べ報告する事を業としており、個人情報にもろに係る仕事である。それゆえ、「それは個人情報ですから・・」の言葉を、調査員は日に何回となく聞かされる事になる。「個人情報だから、どうなのですか?」などと言葉を返したところで、相手は逆に意固地になるくらいで何の解決にもならない。そこで調査員は、あの手この手と、以前の何倍もの労力を費やすこととなっている。

 採用調査の第一は、個人情報の塊である履歴書を基に、その経歴確認を主としたものであり、秘匿にしている個人情報を入手しようとするものではない。それにも関わらず、前職に問い合わせると、「それは個人情報ですから」と、確認にさえ応じて貰えない。居住地の確認作業でも同様の事がいえる。「いや、個人情報をお聞きしよというのではありません。ただ、本人が申告する事項が正しいか否かの確認をお願いしたいだけなのです」と云っても、先ず答えはかえらない。問いに応える応えないは相手の勝手であり、調査員は何らの権利を有している訳では無い。しかし、尋ねる事、応える事が個人情報保護法にふれるかの如くに云われ、お断りの文句が全て「個人情報ですから・・」というものである。既に入手している個人情報の確認すら、「個人情報」を理由にできないという事に成れば、個人情報保護法が施行された当初に危惧された「匿名社会」の到来が現実となり、何が本当か、何を信じればいいのか判らない、人が人を信じることが難しい社会に成りはしないか?。結果的に、個人情報の保護が自己の権利主張のみを声高に叫び、務めなければならない義務は全く果たそうとしない、歪んだ社会に成っていくのでは・・・。

 それを知ってか知らずか、近年履歴書の虚偽申告は非常に増えている。これでは、厚労省が指導する、「公正な採用選考」など出来るわけがない。にもかかわらず厚労省は、「採用時の調査はしないように」との指導を一貫しておし進めている。公正採用を標榜するのであれば、寧ろ採用調査を推進し、ミスマッチの無い公正な採用選考を心がけるべきと指導すべきと思うが、現実は真逆になっている。採用調査を否定する考え方のバックに「応募者の能力資質に関係ない情報の入手を避けなければならない」との思いがあるのはよく理解できるが、現実の採用調査は、応募者の能力資質に特化しており、その前提となる履歴の確認が主なものであるにもかかわらず、その行為が現実には非常に難しくなっている。

 この問題は、今後調査業団体が取り組まなければならない大きな課題ではなかろうか。

What comes to mind at the beginning of the year in a little bit of a daze is the issue of privacy and personal information, which does not always disappear from the corner of my mind. I feel like I’ve written about it several times in the past, but this time I’ve written about it again at length.

Wall to protect personal information

Happy New Year to you all! What kind of New Year’s Day did the members of the Association have?

This year in the Kansai region, the new year began with a mild day that reminded me of a mild spring day, and I was able to greet the new year with a clear feeling. I can’t help but hope that this year will be as refreshing as the beginning of the new year for all of you.

Now, with regard to the subject of personal information, it seems that nowadays it is generally understood that personal information must not be divulged to others without the consent of the individual, and when asked about individuals, some people say, “No, I can’t tell you that because it’s personal information,” while others say, “That’s personal information, can I look into such things? I’ve been told that I’m not going to be able to do that. Isn’t this the reality?

However, it is each person who makes up a society, and when people come together, a community is formed. Moreover, it is the clash of people’s relationships that causes people to associate with people, become friends, and fight. As I was thinking about these things, a very simple question arose.

A person cannot go out with someone without knowing the person’s personal information. However, when I ask about the individual, the answer is, “It’s personal information… However, the majority of conversations are about people, aren’t they? If the wives of the city say, “This is personal information,” they will be removed from the group immediately. Especially for girls’ parties, it is the topic of people’s (personal information) that blooms and creates a community.

The issue of personal information has become a major issue since the Personal Information Protection Law was enacted in 2003. Doesn’t this law say that no one shall divulge personal information without the consent of the person in question? Quite the contrary.

The purpose of the Act on the Protection of Personal Information is “to protect the rights and interests of individuals while giving consideration to the usefulness of personal information,” and personal information is “information about a living individual that can be used to identify a specific individual (name, date of birth, etc.). It is then systematically structured so that specific personal information can be retrieved using a computer. The law stipulates that “the personal information database, etc.” is “systematically organized so that specific personal information can be easily retrieved,” and that those who use the personal information database, etc. for business purposes are “personal information handling companies,” and stipulates the handling of personal information for these personal information handling companies.

So to speak, it is a law that allows personal information to be easily retrieved using computers, etc., and is intended for businesses that use it for business purposes. In addition, when a “personal information handling company” that is subject to this law collects personal information and uses it, it must not use it for any purpose other than the purpose for which it was collected, and must obtain the consent of the person in question before using it.

This is not a law that targets every single citizen, but rather a law that targets “personal information handlers” who collect large amounts of personal information. Therefore, it is not subject to any charge (regulation of the law) to talk about “where he or she is living, what he or she is doing, how old he or she is, what kind of person he or she is,” etc., on the individual’s own responsibility. If such a law were in place, people would not be able to lead a social life and communities would not be established. In spite of this, there are many people who say, “That’s personal information,” with a knowing look on their face, as if they think they are a respectable person with a strong spirit of compliance.

Since when did the Personal Information Protection Law become such a thing…?

Our company mainly conducts a preliminary investigation at the time of hiring, and based on the resume and work history submitted by the applicant, we investigate and report whether the resume and work history are correct or not, how the applicant’s work performance and work abilities were at the previous job, and what the applicant’s personality and behavior are like. That’s why investigators are told “That’s personal information…” several times a day. It’s private information, so what about it? It doesn’t solve anything because the other person becomes stubborn on the contrary. So, the investigators have had to spend many times as much time and effort as they did before.

The first part of the hiring investigation is mainly a background check based on the resume, which is a mass of personal information, and not an attempt to obtain personal information that is kept confidential. In spite of this, when I contacted my former employer, they wouldn’t even confirm it for me, saying, “That’s personal information. The same can be said of the work of confirming residence. No, I’m not asking for personal information. I just want to ask you to confirm whether or not the information you give us is correct,” he says, but he doesn’t respond. It is up to the investigator to respond to the question, and the investigator does not have any right to do so. However, when asked or answered, they are told as if they are in violation of the Personal Information Protection Law, and all of the refusal clauses are “This is personal information… If it becomes impossible to even confirm personal information already obtained on the grounds of “personal information,” the “anonymous society” that was feared when the Personal Information Protection Law was enacted will become a reality, and we will become a society where people do not know what is true or what to believe, and where it is difficult for people to trust others. As a result, the protection of personal information will lead to a distorted society that only shouts out its own rights and does not fulfill its duty to do so.

Whether you know it or not, the number of false resumes has been on the rise in recent years. There is no way that the Ministry of Health, Labour and Welfare will be able to do the “fair selection of recruits” it is instructed to do. In spite of this, the Ministry of Health, Labour and Welfare (MHLW) has consistently pushed ahead with the instruction not to conduct surveys at the time of recruitment. If the government is advocating fair hiring, I think it should be instructed to promote hiring surveys and ensure that there are no mismatches in the hiring process. It is understandable that there is a belief that “we must avoid obtaining information that is not related to the applicant’s abilities and qualifications” on the back of the idea of rejecting recruitment surveys, but in reality, the act of doing so is very difficult, despite the fact that recruitment surveys are specific to the applicant’s abilities and qualifications, and their main premise is to confirm the applicant’s history.

This is a major issue that investigative organizations need to address in the future.
