昨日、２月２６日（木）、北浜の開平小学校の生徒４名と引率の先生１名が弊社に来た。

これは、所属する大阪船場ロータリークラブの奉仕活動の一環で、地域の子供たちに何かできることは無いかとの考えから、
大阪船場地区にある唯一の小学校（開平小学校）に声がけをしたところ、校長先生より、「本校の立地は、商都の中心地に在り、
昼夜の人口差が極端で住居スペースが少なく、従来の地域社会の存在が成り立ちにくいところになっている。子供たちは、
家庭と学校との往復だけで、地域の大人と日常的に接する機会が殆どない。そこで、ロータリーのオーナーさんに地域の大人として子供たちに、
これまでの人生経験や未来を担う子供たちに託すメッセージを話してやって頂けないか・・・」との提案があり、
それを受けての企業訪問であった。

午前１０時１５分の来社予定であったが１０時には到着したとの受付からの電話。慌てて出迎えに行き、６階の私の部屋に案内。
子供達は一寸緊張気味であったが皆がいっせいに”お早うございます”と元気よく挨拶、
その後６年生の一人が代表となり、”おいそがしいなか、私たちのために大切な時間を取って頂き、
本当に有り難う御座います”と立派な挨拶をしてくれた。余りにキチッと挨拶をされ、こちらが一寸とまだってしまった。

校長先生からは「お話をメインに・・」との事であったが、話ばかりでも・・と思い、この地の通称弁護士村とか司法村と呼ばれる地域
（裁判所、法務局、警察、弁護士会館）を一通り案内し、その後１０時３０分から１時間、私の生い立ちと人生観、職業観をお話させて頂いた。
たいした面白くもない話であったとおもうが、それでも子供達は１時間、真剣な眼差しで一生懸命に聞いてくれた。

とてもありがたかった、正直、子供たちへの感謝の気持ちでいっぱいになった。「地域の子供たちに何かしてあげよう」
との思いから企画されたものであったが、終わってみれば逆に、子供たちに奉仕されていた事に気がついた。つたない自分の人生を語り、
それを真剣に聞いてくれた子供たちに、本当に感謝感謝でいっぱいになった。得がたいとても幸せな一日であった。

昨日（２月２４日）の産経新聞の記事によると、橋下大阪府知事が戸籍謄本、住民票の第三者請求に対し、
本人への通知システムの導入を提唱し、府下５から１０の市町村が来年度からの実施を検討しているという。理由は、
不正入手防止の為となっている。

で、マッチャンは怒り心頭。何でそんなことで？、戸籍や住民票の不正入手防止が出来るのであれば良いではないか、
自分の戸籍や住民票を他人が勝手に取るのを防ぐためと云うのだから良いではないか、何でそんな事で怒るの？。
一般的には誰でもそう思うでしょう。だから、橋下知事は某運動団体から言われるままに何も難しい事は考えず、
良い事は早くやろうとお考えになられたのでしょう。

ところが戸籍、住民票に関しては一寸違うのです。これは国民の安全に関する重要な問題を含んでおり、
社会生活に重大な影響を及ぼす事項なのです。その事について一寸くどくなるが小生の癖、少し我慢して読んで欲しい。

戸籍、住民票は元々公開を原則としており、誰でも他人の戸籍や住民票を見ることができた。何故ならその必要性があったから。所謂、
人の身分を証明するものは戸籍しかなく、出生、結婚、親子関係、死亡事項等が記録され、戸籍によって日本国民であることが証明されている。
それだけに、この戸籍は誰でも見れるようにしておかないと、その人が誰なのか判らないことになる。非公開にすれば、
名前も年齢も親子関係も結婚の有無も判らず、本人が言う事を信用するしか無いことになる。日本人かどうかさえ判らなくなる。
その為に戸籍が作られた明治以降一貫して公開の原則が護られてきた。

ところが、古い戸籍（明治の頃）の中には旧身分制度（士農工商）の族称が記され、士族、平民、
新平民誰だれと名前の頭につけられていた。その為、結婚の際などに戸籍をみるとその家が昔、侍であったのか百姓であったのか、
それとも被差別部落の人であったのかが判ることがあった。そこで、戸籍が差別に使われるおそれがあり、それを無くすために昭和になると、
この族称を戸籍から外し、昭和４０年頃には古い戸籍の族称を全て墨で塗りつぶし判らない様な処置をした。それでも、
塗りつぶし方によっては族称を推察できるようなものもあり、昭和５０年頃に除籍（除かれた古い戸籍）は第三者は取れないようにし、
取れるのは現戸籍のみと改正した。この法改正により、戸籍が部落差別の材料に使われることはなくなった。

にも関わらず、運動団体の圧力に屈した各市町村は、戸籍法に「何人も理由を明らかにすることにより戸籍の交付請求ができる」
と決められているにも関わらず、但し、「不当な目的に使われる事が明らかな場合は拒むことができる」となっているのを拡大解釈し、
実際には第三者請求には応じない取扱いにした。所謂、
正当な理由があっても第三者請求には応じないと云うのが各自治体の一般的な取扱いになっていた。

そこで、他人の戸籍を必要とする事案があると、職権で戸籍が取れる弁護士、司法書士、行政書士などに頼んで入手してもらうと云う、
問題のある手段が一部で行われていた。その中に探偵社や興信所が多くあった。ところがこうした手段を使っていた者にもそれなりの理由があり、
何人も理由を明らかにして交付請求できるとなっているにも関わらず、請求してもそれに応じない自治体が悪いのであるから、
手段に問題は有るとしても取れる方法で取っていた、と云うのである。

ところがこの手段が明るみに成って運動団体が政府に強力な圧力をかけ、２年ほど前に戸籍法の一部改正を行い、
弁護士や司法書士などの有資格者以外は他人の戸籍を取るのは非常に難しくしいものに法改正した。

改正の趣旨は、不正入手の防止と戸籍の中に「摘出でない子であることや、離婚歴など、
その本人にとってみれば他人に知られたくないとおもう事項もふくまれている」。従って、
他人に知られないようにするため第三者の交付請求はできないように改めたと云うわけである。

所謂、部落差別云々ではなく（部落云々は既に戸籍では判らない）、戸籍には他人に知られたくないと思うこともあるから、
秘匿にしてしまう為に戸籍法を改正したというのである。戸籍の重要性や戸籍を見れなくするとどう云う弊害が起こるか？、
などは殆ど議論せず、個人情報やプライバシーに関わることは全て秘匿し、
個人の事は本人が言う事を全て鵜呑みにする以外に方法がないようにしたのである。
身分を隠し悪さをしようとする人を擁護するための法改正を行ったとしか考えられない法改正を行ったのである。

その上に、橋下大阪府知事は、府下市町村に第三者からの戸籍請求があった場合、本人に請求があったことを通知するシステムを提唱し、
それを５から１０市町村が採用する方針だと云うのである。何も考えずに運動団体から言われたから遣るとしか思えない、
極めて短絡的な提唱である。

国民の多くが自己の利害関係者（婚約者、交際をしている相手、商取引関係者、貸借関係契約者等など）が、
真に誰であるのか、言っている事が本当なのか、疑問を感じた時に、調査する事によって判明するような仕組みにしておかないと大変な事になる。
ところが身分を証明する唯一の公的書類の戸籍を秘匿にし、若し何らかの方法で交付請求しようとすると本人に通知するというのである。
これでは民事トラブルの製造工場を役所が作るようなものである。

結婚だろうが商取引だろうが詐欺を行おうとする人の大半が身分を誤魔化している。偽名を使い、住所を偽り、
経歴を偽り、親子関係を偽り、結婚や家族、親族関係を偽っている。ところが、こうした偽りを確認するシステムを排除し、
もし調べようとすると、その事を悪事を働こうとする人に役所がご丁寧にお知らせすると云うのである。

詐欺と思えば訴訟を起こし裁判をすれば良い、と弁護士は言うでしょうが、
一般的に騙され被害を被ってから裁判などしても大半は後の祭りである。探偵社や興信所が行うのは疑いをもった時点で、
転ばぬ先の杖として調査するのである。それを全て相手にお知らせするシステムを提唱したのが、あのお偉い大阪府知事だと云うのである。

我が国に於ける調査業界のこの不況、私はこの業に関係し４０年になるが未だ過って経験した事がない。
原因はサブプライムローン等と云うグローバルなものでは無く、
自ら墓穴を掘ったと云われても仕方が無い社会的信用の低さと業界を取巻く法規制と偏向した行政指導によるものと思われる。英・
米国に於ける調査業は弁護士等よりも社会的信用度は高く、一定の手続きさえ踏めばセンシティブな個人情報でも入手でき、
採用調査（雇用調査）は採用マネージャーが行わなければ成らない最低限の任務（ネグレジェント・
ハイアリングなる考え方）とされ、商取引に於いては、会社は勿論、経営者、役員、
主要株主の身元調査を詳細に行い、住所履歴・犯罪歴・職歴・学歴・
クレジットカード履歴・留置裁判履歴・
法的違反歴などの調査を義務ずけ社内のコンプライアンス委員会への報告をルール化しているのが一般的とされている。
これは犯罪や不正防止のため企業が最低限果たさなければならない社会的責務と捉えられているが為である。ところが日本に於いては全く逆で、
採用調査や取引先の経営者や役員の身元調査は社会悪と捉え、
厚生労働省や地方自治体の多くは人権やプライバシー保護を理由に「身元調査はしないように・・」との行政指導を行っている。
いったいこの差はどこから来たのであろう。単に「文化の違い」という人もいるが簡単に文化の違いで片付けられる問題ではない。
私は社会的な大問題と捉えている。最近の社会風潮に見られる個人の権利利益のみを主張し、
義務や責任は眼中に無い身勝手な人が横行する背景に、
人権やプライバシー保護を声高に叫ぶ人権至上主義の偏った考え方が見え隠れするからである。
人は何処かで誰かから見られている事を意識することによって自己規制する事ができ、悪いことをすると後で報いが来る事を知っていた方が良い。
再生出来ない社会はいけないが人は何かで調査される事がある事を知っていたほうが良い。
放蕩による自己破産でも直ぐに免責され殆どペナルティーのない今の社会は何処かおかしい・・・。

We shouldn’t have a society that can’t be regenerated, but it’s better to know that people can be investigated for something.
