戸籍法の一部改正

先週、今週と連ちゃんで東京出張となった。週の内に2?3日出張が入ると、その週は何となくあわただしく落ち着いた気分に慣れない。単に場所が変わるだけだが出張となると何となく気分が変わる。
ただ、私は汽車に乗ることは全く苦にならない。寧ろ楽しみである。汽車と言っても新幹線は今ひとつ情緒に欠けるが、それでもいっこうに苦にならない。コーヒーを飲みながら好きな本を読み、本に飽きると景色を楽しみ、眠気が来ると気兼ね無くうつらうつら・・、そんなに気儘にしていても汽車はキッチリ私を目的地に連れて行ってくれる。時間が倍に使えて何となく得をした気分になるからである。
出張の目的は、今国会に上程される「戸籍法の一部改正案」に関する陳情で、自民党の法務委員の先生方に「要望書」を持ってお願いにまわる為であった。衆・参議員会館の最上階(7階)から順番に各議員の部屋を訪問し、お願いする。代議士が在室であれば直接、不在時は秘書の方に「戸籍が非公開になった場合の弊害」を訴え、理解を求めようということである。
「結果はともかくとして遣れるだけの事はやろう」との思いである。社会的に相当厳しい目でみられれている調査業界の陳情などまともに聞いて貰えるとは考えていないが、この問題は国民の誰もが、「不振」や「疑問」を抱いたときに相談を受ける事が多い調査業者でしか知りえない事項が多くあり、「戸籍を非公開にした時の国民の損失」を、声を大にして訴えてきた。
以下は、今回の要望書の一部である。これに以前このブログでも紹介した「調査事例」を添付し上申した。
調査業界は、一般市民や企業からの依頼を受け、種々の調査を行い、結婚詐欺や取り込み詐欺などの被害を未然に防ぐなど、我が国の社会安全と秩序の維持並びに人権擁護にいささかなりとも貢献していると自負しております。私どもの調査活動の中で、戸籍は住民票とともに被調査者を特定できる事実上唯一の公的情報であるため、戸籍が原則非公開となると、調査活動に重大な支障をもたらし、依頼者に質の高い報告ができなくなり、延いては、我が国の誇る社会安全に重大な影響が出るものと懸念されます。
そのような背景から、1昨年から始まった今回の「戸籍法の見直し」の動きには特段の注意を払い、その審議の成り行きを見守ってきました。そして、昨年の8月には、見直しの「中間試案」に対するパブリックコメントも行なわれました。
このパブリックコメントの集計結果を踏まえて開かれた、法制審議会戸籍部会第11回会議(平成18年9月19日)の議事録には、「公開の制限」について意見が分かれており、それぞれの意見が紹介されています。私どもが指摘した戸籍公開の有用性についての具体的事例(添付資料をご参照下さい)も一部紹介されてはいるものの、それについて審議された様子は一切うかがえません。また、「戸籍を広く資料として使用することが真実の発見につながる」や「全く社会的な必要性というものを無視して、今回戸籍法の改正がなされるということについては非常な危機感を持っております」といった一部委員の正当な意見は、「戸籍の非公開」が今回の法改正の趣旨として、これら制限を緩める意見を一蹴しています。
一方、非公開制に賛成な意見の際だった特徴は、具体的に論証することはせず、ただ法改正の趣旨を錦の御旗にして、調査業者などによる戸籍の交付請求を「全て不正なもの」と決めつける偏向した意見に終始しております。
私どもは、その法改正の趣旨こそが大問題だと考えています。今回の法改正を実質的に推進しているのは、パブリックコメントにも組織的に多くの賛成意見を寄せた一部の人権擁護団体でありますが、その幹部が常識では考えられない不正を積み重ねてきた事実は、大阪市の飛鳥会事件、奈良市職員の給与不正受給や京都府清掃局の不祥事などから明らかになっています。ところが、戸籍部会における審議には、その組織の体質からでた重大な不祥事の影響を受けた形跡が一切見当たりません。特に、奈良市と京都府の事件はパブリックコメントが締め切られた後に発覚したものであるにもかかわらず、無視され続けています。この事件に対する地方自治体の対応ぶりを見ると、自治体職員が人権擁護を標榜する団体の恫喝に如何に弱いかがよく分かります。そのため、市町村長の判断で戸籍の公開が認められている現法体系下にあっても、弁護士等の有資格者以外の第三者からの戸籍交付請求には応じて貰えないのが現実です。
戸籍を非公開制にすれば、身元確認が容易にできないことを背景に、詐欺や詐称事件が蔓延する社会が到来し、インターネットの普及とともに進んできた匿名社会がさらに深刻なものとなり、世界に名だたる「醜い国、日本」になってしまいます。
審議会事務局によれば、次回の通常国会に改正案を提出するというスケジュールになっているとのことでありますが、私どもと致しましては、今回の性急な法改正は一旦留保し、 戸籍の公開制により確保されてきた社会安全や秩序の維持と非公開とする事によるメリット (漠然としたプライバシー保護)との得失を、できれば数量的に評価した上で、戸籍というすばらしい社会的財産をどのように活用すべきかの論議を慎重に進めていただきたいと切望しています。昨今の弊害の多い行き過ぎた情報非公開制の流れを見直すよい機会ではないでしょうか。そして、身分登録簿の公開制を堅持している英国やスエーデンなど、人権擁護についての先進諸外国の状況を参考にするとともに、弁護士や司法書士などの有資格者からの意見だけでなく、訴訟といった深刻な事態に陥る前に一般市民の被害を最小限に食い止めることに貢献している調査業界の意見も採り入れて頂きたいと願っております。
なお、私ども調査業界は、守秘義務とコンプライアンスの徹底を一層推し進め、一般市民がさらに安心して依頼できる組織づくりを目指しています。

I went on a business trip to Tokyo last week and this week in Ren-chan. If you have a couple of business trips during the week, it’s hard to get used to the hustle and bustle of the week. It’s just a change in location, but when it comes to business trips, my mood changes somehow.
However, I don’t mind riding the train at all. I’m looking forward to it. The Shinkansen lacks emotion even though it is a train, but I don’t mind it at all. I read my favorite book while drinking coffee, enjoy the scenery when I am tired of the book, and when I feel drowsy, I do not hesitate and doze off…Even if I am so selfish, the train takes me to the destination exactly. It’s because I feel like I’m using my time twice as much and somehow gaining something from it.
The purpose of the trip was to go to the LDP’s legal affairs committee with a letter of request to make a petition regarding a partial amendment to the Family Registration Law, which was to be submitted to the Diet. We will visit each council member’s room in turn from the top floor (7th floor) of the House of Representatives and Councillors and ask them to do so. If a delegate is in the office, he or she should appeal directly to the secretary when he or she is not in the office and ask him or her for his or her understanding of the adverse effects of keeping the family register private.
Putting aside the result, I thought, “Let’s do as much as we can. I don’t think they will listen to the petition of the investigation industry, which is being looked at very harshly by the society, but there are many matters that only the investigation agency, which is often consulted when any member of the public has a “slump” or a “question”, can know about this issue, and I have appealed loudly for the “loss of the people when the family register is made private”.
The following is part of this request letter. I have attached the “case studies” that I have previously written about on this blog to this application.
The investigative industry is proud of its contribution to the maintenance of social safety and order and the protection of human rights in our country by receiving requests from the general public and companies to conduct a variety of investigations and prevent damage from marriage fraud and other frauds. In our research activities, the family register is virtually the only public information, along with the resident’s certificate, that can identify the person being investigated. Therefore, if the family register is kept private, in principle, it will seriously impede our research activities and prevent us from providing high-quality reports to clients.
Against this backdrop, we have been paying special attention to the “review of the Family Registration Law” that began the year before last, and have been watching the progress of the deliberations. And in August of last year, public comment on the “interim draft” of the review was also made.
In the minutes of the eleventh meeting of the Family Registration Subcommittee of the Legislative Council (September 19, 2006), which was held based on the results of the tallying of public comments, there are divided opinions on the “restriction of public disclosure” and each opinion is introduced. Although some specific examples of the usefulness of disclosing family registers that we have pointed out (please refer to the attached materials) are introduced, there is no indication of any deliberation on the issue. In addition, some of the members’ legitimate opinions, such as “the wide use of the family register as a resource will lead to the discovery of the truth” and “we have a very strong sense of crisis that the Family Registration Law will be amended this time without regard to the social necessity”, overruled the opinion that “non-disclosure of the family register” is the purpose of the amendment of the law to loosen these restrictions.
On the other hand, the opinions in favor of the non-disclosure system were characterized by biased opinions that used the purpose of the amendment of the law as a banner and determined that “all requests for the delivery of family registers by investigators and others were fraudulent” without providing specific arguments.
We believe that the intent of the amendment is a major problem. The fact that the executives of these organizations have accumulated unthinkable injustices has become clear from the Asuka-kai case in Osaka City, the unfair receipt of salaries of Nara City employees, and the scandal of the Kyoto Prefectural Cleanup Bureau. However, in the deliberations of the Family Register Division, there is no indication that the organization has been affected by any serious scandals. In particular, the incidents in Nara City and Kyoto Prefecture continue to be ignored despite the fact that they were uncovered after public comment was closed. Looking at the way the local government responded to this case, it is well understood how weak local government officials are to threats of groups advocating the protection of human rights. Therefore, the reality is that even under the current system of law, which allows the public disclosure of family registers at the discretion of the mayor of the municipality, a request for delivery of family registers from a third party other than a qualified person such as a lawyer will not be accepted.
If the family register is kept private, we will have a society in which fraud and misrepresentation will be rampant against the backdrop of the inability to easily verify identity, and the anonymous society that has developed with the spread of the Internet will become even more serious.
According to the Council’s secretariat, the schedule for submitting the amendment to the next ordinary session of the Diet is set to be the same as the schedule for submitting the amendment to the next ordinary session of the Diet. We hope that the Council will put this hasty amendment to the law on hold and carefully discuss how to make the best use of the wonderful social asset of the family register after assessing, if possible quantitatively, the merits and demerits (vague protection of privacy) of keeping the family register private and maintaining social security and order, which have been ensured by the open system of family register. I think this is a good opportunity to review the recent trend of excessive nondisclosure of information, which has many evils. In addition to the opinions of lawyers, judicial scriveners, and other qualified persons, we would like to hear the opinions of the research industry, which contributes to minimizing the damage to the public before it becomes a serious situation such as litigation.
In addition, we, in the research industry, will further promote the duty of confidentiality and thorough compliance, and aim to create an organization where the general public can make requests with greater peace of mind.
