個人情報過保護法

私は調査業の立場から、何回もこのブログで個人情報保護法施工に伴う問題点を指摘してきたが、
昨日の読売新聞にも行政の個人情報保護法に対する過剰反応が問題視され、
救急時の対応やその為の情報交換にまで大きな支障を来たす結果になっている事が指摘されていた。

また、マスコミ報道によると、今国会で戸籍住民票の閲覧及び取得に関する諸問題が討議されるようであるが、
このままの流れからいくと多分に第三者的立場の人は、本人の承諾(委任状)無くしては、
他人の住民票や戸籍は見る事も取ることも出来なくなるよう、法的に規制される可能性が非常に高い。既に行政の窓口では10数年前より閲覧、
取得共に厳しく規制されており、公開の原則は既に有名無実化しているものの、これがキッチリ法的に規定されるとなると話は別である。所謂、
本人の承諾無くしては何人も戸籍や住民票を見る事も取ることも出来ないとなると、いったいどんな社会になるのだろう。大体、
戸籍や住民票は何の為にあるのか、何の為に必要なのか、官が民を監視する為にだけあるのか、決してそんなものではない。
自分が自分であることを証明する唯一の公的証明書では無かろうか。それ故に法的に公開の原則を貫いてきたのではないのか・・。ある意味、
最低限自分の事(住所、氏名、年齢、家族構成)が公的機関で公開されている事によって、
知らず知らずの間に自己規制ができ社会規範が保たれて来たのではなかろうか。

そのたがをはずそうとするのが今回の法改正である。個人情報保護の印籠のもとに、
本人の承諾無くしては名前も住所も年齢も知ることが出来なくなる。これを逆手に取るとそれこそ嘘のつき放題、詐欺のし放題、学歴は書き放題、
職歴は言い放題、年齢のごまかしなどお茶の子さいさい、結婚離婚を何回繰り返しても常に初婚でOK、既婚者も彼女彼氏の前では常に独身。
そして、調査会社が調査をして、「被調査人は独身ではなく何年何月にだれそれと結婚して子供2人をもうけ、某所でこんな生活をしています」
と報告したとする。すると、被調査人は「私の個人情報をどこでどうして入手したのか公開しなさい。
私が結婚して子供が居ることを貴方はどうして証明できるのか・・、こんな報告書は出鱈目だ・・」云々と。ところが調査会社は、
「戸籍でこうなっているではないか・・、住民票でこうではないか・・」などと口が裂けても云えない。また、
少し利口な被調査人は自分の本籍地や現住所の役所に自分の住民票、戸籍が何時誰によって取られたか問い合わせをする。
すると役所はすぐに調べて本人に通知する(そうしなければならない)。某司法書士、某弁護士の名前が出て来ると、
その司法書士や弁護士は目的外請求でオジャンである。従って、有資格者も直接の業務以外では依頼しても無理である。結果、
何でもありの社会が確立され、人は人を信用することは出来ず、個人情報やプライバシーの名のもとに詐欺師王国が出来上がるのである。

それは少し飛躍が過ぎるのでは・・と思われる方も多いのではないかと思うが、実際に調査をしている現場から見ると飛躍でも何でもない。
既に、そのような社会になりつつある。既婚の単身赴任者が独身顔で彼女を云々はザラ・・。履歴書の詐称は言うに及ばずであるが、企業は
「個人情報保護法の関係で個人の事は一切お応えできません・・・」と、それが模範解答のように云う。ところが、自分のところの採用では、
調査会社に「確り履歴を確認してくれ」と厳命してくる。一事が万事である、行政はもう少し全体を考えて事に対処して貰いたいと思う・・。
弱者がすべて正義とは限らない。

  3. ブログを順次読ませていただいております。個人情報保護法、戸籍法改正の流れなどについて、このまま見過ごせば、その弊害が今後の日本社会に浸透していくことは目に見えております。決して調査会社の利得を目的としたご意見ではないと思いますし、敢えて実例を掲げて訴えられている姿勢に感服しております。引き続き本ブログを読ませていただき勉学させていただきたいと思います。
