個人情報過保護法

探偵のぼやき2005/08/03

今朝の読売新聞一面のトップ記事は個人情報保護法施行に伴う対応のまずさを指摘したものであった。文中、匿名社会の到来を危惧し、
これでは「個人情報過保護法」と嘆き、法案の見直しが必要になるのでは、とあった。我が意を得たりと、久しぶりに溜飲が下がる思いであった。

全国調査業協会(調査業の全国団体)から会報発行に伴い、「何か記事を書け」とのお達しがあり、
昨日その原稿を書いたところに今日の新聞記事である。そんな事で、今日は手抜きして、その原稿を掲載するすることにする。

 

調査業を取り巻く環境

調査業界にとってこれほど厳しい環境になった事が過去あったであろうか・・?。バブル崩壊以後の経済環境もさる事ながら、
悪徳探偵社の横行による業界への不信感、人権プライバシー意識の高揚、個人主義の横行、戸籍住民票問題、そして個人情報保護法の施行。
よくこの厳しい環境の中で調査業を続けていられるものだ、と我ながら感心する程である。中でも問題なのが本年4月に施行された
「個人情報保護法」なるものである。この法律を簡単に言えば、コンピュータの普及に伴う情報化社会の中で、
個人情報の大量流出などが問題となり、法制化の必要性が出てきた為のものである。従って、この法律の義務規定の対象となる者は、
5000件以上の個人情報をコンピュータ等を用いて検索できるよう体系的に構成した「個人情報データベース等」
を事業のように供している事業者(個人情報取扱事業者)である。にも係わらず一般的には、
「個人情報は本人の承諾なくしては話すことも取ることもダメ」と法律で決められた、と解釈しているものが多く、
全く法律の対象でない家庭の主婦までが「そんな事は個人情報ですから言えません」などと極々普通にのたまう。
それが企業ともなると尚更である、「そんな個人の事など・・法律で禁じられたのをご存知ないんですか・・」などと説教までされるしまつ。
やり難いことこの上ない。当社は特に採用に係わる仕事が多く、7割方が雇用調査である。しかも大半が中途採用時の調査であり、
応募者本人が提出した履歴の確認が大きなウエートを占める。ところが、今年4月の個人情報保護法施行いらい多くの企業が、
この経歴確認にさえ応じなくなった。「個人情報は一切口外できません」と木で鼻を括ったような返事が返って来る。従って、
調査員は手を変え品を変えで、取材に趣向を凝らさなければならない。結果時間が倍掛かることになり、しかも、
今ひとつ歯切れの悪いレポートになってしまう。クライアントは、「時間はかかるは内容は寂しいは・・」と不満顔。
特に官公庁や大手企業は個人情報漏洩に神経質に成るあまり、人に関する事は一切話せないとの姿勢を取っている。
もし本当にそこまで規制した法律であるならば、多分今の社会生活は営めなくなる。人と人の会話は八割方人に関する話では、
ご婦人方の大好きな井戸端会議などは九割を超えるのでは・・、会社に於いても同様で結構人に関する話題が多い。退職した先輩から
「彼は今どこにいる・・」等と聞かれても、「イヤ、それは個人情報ですから」とお答えするしかなくなる。そんな法律である訳がないのに、
企業は事なかれ主義、利己主義に徹し、個人情報の名のもとに一切の口外を避けている。法律なるものは人間が人間らしい社会生活が営めるよう、
最低限護らなければ成らないことを決めているのであって、決してギクシャクした社会を作るためにつくられるものではない。
所が最近の日本人は自分なりの判断、思考というものを無くしているようで、全てお上の言うこと、会社の言うことを、
唯ただご無理ごもともと聞くマニュアル化人間に成り下がっているようである。「個人情報は言ってはダメ」と言われれば、何の疑問もなく
「ハイ判りました」としているのであろう。かくして日本は詐欺師天国、嘘のつき放題国家、ひいては犯罪国家へとひた走ることになる。
これからは、学歴も職歴も書き放題言い放題、誰も確認することができないのだから、東大、京大卒が実数の2倍3倍に増え、
元警察官がゴロゴロ、大蔵官僚がわんさかとなり、何が本当か何が嘘か全く分からなくなって行くことでしょう・・・。だって、
個人の情報は本人の承諾なしには取れなくなるし、調べてもいけないらしいから・・・。
